EPBC Referrals

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) enables the Commonwealth Government to join with the states and territories in providing a truly national scheme of environment and heritage protection and biodiversity conservation.

The EPBC Act focuses Commonwealth Government interests on the protection of matters of national environmental significance, with the states and territories having responsibility for matters of state and local significance.

Three referrals under the EPBC Act were submitted to the Department of the Environment, Water, Heritage and the Arts (DEWHA); the first two by Shaw River Power for the power station and gas pipeline and the third by Wannon Water for the water supply pipelines.

The power station has been assessed as ‘not a controlled action’. The gas pipeline and water supply pipelines have both been assessed as ‘not a controlled action if undertaken in a particular manner’.
