Approval Process

Under the Victorian Environment Effects Act 1978 a referral was submitted to the Victorian Minister for Planning in October 2008 for a determination as to whether an EES would be required for the proposed power station. On 7 November 2008, the Minister determined that an EES would be required.

The proposal will require an amendment to the Moyne Planning Scheme and approval of a cultural heritage management plan under the Aboriginal Heritage Act 2006. It will also require a works approval under the Environment Protection Act 1970 and a pipeline licence under the Pipelines Act 2005.

Referrals under the Commonwealth Environment Protection and Biodiversity Conservation Act 1999 have concluded as indicated.

Approvals, licences, consents and permits required for the three main components of the project include:

For the proposed power station

  • An amendment to the Moyne Planning Scheme under the Planning and Environment Act 1987.
  • Works approval and licence under the Environment Protection Act 1970.
  • Registration and a licence to operate a major hazard facility under the Occupational Health and Safety Act 2004.
  • Generation licence and connection agreement under the Electricity Industry Act 2000.

For the proposed gas pipeline

  • Licences to construct and operate a gas pipeline under the Pipelines Act 2005.
  • Works approval for a compressor station under the Environment Protection Act

  • Connection agreement under the Gas Industry Act 2001.

For the proposed water supply pipelines and water infrastructure

  • Licence to construct works under the Water Act 1989.
  • Works approval and licence under the Environment Protection Act 1970.
  • Planning permit or planning scheme amendment under the Planning and Environment Act 1987.

The project as a whole will require approval of cultural heritage management plans under the Aboriginal Heritage Act 2006, permits for construction work on or beneath a waterway in accordance with the Water Act 1989, permits to remove protected flora and fish under the Flora and Fauna Guarantee Act 1988, and a net gain agreement in accordance with the policy requirements of Victoria’s Native Vegetation Management: A Framework for Action.
